The SQP Software and the SQP Database are owned by the Universitat Pompeu Fabra (hereinafter referred to as “UPF”) whose Tax Identification Number is Q5850017D and head office at plaça de la Mercè 10-12, 08002 Barcelona, represented by its Vice-rector for Knowledge Transfer, Dra. Eulàlia de Nadal Clanchet, by virtue of the powers granted by article 4 of the Rector's Resolution of May 31, 2021, regarding the delegation of powers to the vice-rectors and to the general secretary of Barcelona.
UPF provides GESIS – Leibniz-Institut für Sozialwissenschaften e.V. (hereafter referred to as “GESIS”), registered with the Local Court of Mannheim under number VR1449, whose head office is at B6, 4-5, 68159 Mannheim, post office box 122155, 68072 Mannheim represented by its president Prof. Dr. Christof Wolf, the use of SQP Software and the assignment of SQP Database by contract.
This document regulates the use of the Internet Website (hereafter, SQP) to which you have just accessed, owned by GESIS. The use of SQP provides you the condition of User and implies its full and unreserved acceptance to each and every provision included both in this document and in the Privacy Policy, in force at each moment in which the User access it, so if you do not agree with any of the conditions set forth herein, you should not use/access SQP. The UPF and GESIS reserves the right to modify at any time the present Conditions of Use of SQP as well as any other General or Particular Conditions, Regulations of use, Instructions or notifications that may be applicable. Furthermore, the UPF and GESIS reserves the right to modify, suspend, interrupt or stop operating SQP at any time. Consequently, the User must carefully and thoroughly read this document in its entirety. All those natural or legal persons resident or domiciled in other countries of the European Union or outside the European Union must ensure that the access and use of SQP and/or its content is allowed in accordance with its own legislation. In any case, access to and use of SQP by a user who is not domiciled in Germany, in particular, is at the user's own risk and releases UPF and GESIS from any liability to the extent permitted by applicable law.
Through SQP, GESIS provides Users access to various contents, services, information and data. The "Contents" are made available to Users by UPF and GESIS or by third-party providers or by other SQP Users. The UPF and GESIS reserves the right to modify at any time the presentation, configuration and location of SQP, as well as the Contents and the conditions required to use them.
The User knows and accepts that the access and use of SQP and/or of the Contents included in it takes place freely and consciously, under his/her exclusive responsibility. The access to SQP and/or the Contents included in it does not imply any kind of guarantee regarding the suitability of SQP and/or the Contents included in it for private or specific purposes of the Users. The UPF and GESIS could establish further limitations and/or additional conditions for the use and/or access to SQP and/or the Contents, which must be observed by the Users in any case. All personal information provided by the User must be truthful. For these purposes, the User guarantees the authenticity of all the data communicated as a result of completing the necessary forms for the subscription of the Services or access to contents. Furthermore, it will be the responsibility of the User to keep all the information provided to the UPF and GESIS permanently updated so that it responds, at all times, to the real situation of the User. In any case, the User will be solely responsible for the false or inaccurate statements made and the damages caused to UPF and GESIS or third parties for the information provided. The User agrees to make an appropriate and lawful use of SQP and the Contents, in accordance with the applicable Law, these Conditions of Use, morality and generally accepted good practices and public order. To access and use the restricted access area, Users must register in advance by filling out a form (the "Registration Form") available on the SQP website. The data entered by the Users in the Registration Form must be exact, current and true, at all times, and will be processed by GESIS in the way indicated in the Privacy Policy. The non-registered users will have access to a demonstration version of SQP with limited functionalities.
The User knows and accepts that all industrial and intellectual property rights over the Contents and/or any other elements inserted by Users in SQP belong to the UPF. The Content inserted by the Users will be public at the SQP website but anonymized. In any case does the access to SQP imply any type of waiver, transfer, license or total or partial cession of said rights, unless expressly stated otherwise. The present Conditions of Use of SQP do not confer to the Users any other right of use, alteration, exploitation, reproduction, distribution or public communication of SQP and/or its Contents other than those expressly provided herein. Any other use or exploitation of any rights will be subject to the prior and express authorization specifically granted for this purpose by the UPF and GESIS. The UPF and GESIS authorizes Users to use, view, print, download and store the Contents and/or the elements inserted in SQP exclusively for their personal, private and non-profit use. Exceptionally, when the use of any of the Content included in SQP has academic purposes, the use of those contents will be allowed if it is duly referenced. For this the User must mention that the Contents have been generated using Survey Quality Predictor (SQP) 3.0, created by Willem Saris and further, developed by the SQP team at the Universitat Pompeu Fabra, GESIS and collaborators. For any other use than those expressly permitted, it will be mandatory to obtain the prior written consent of the owner of the rights in question.
In order to use some of the Services or access certain contents, Users must provide GESIS with certain personal information beforehand. GESIS makes its personal data protection policy available to the User in the Privacy Policy section.

The UPF and GESIS reserves the right to exercise as many actions as are available in law to demand the responsibilities arising from the non-compliance of any of the provisions of these Conditions of Use of SQP by a User. UPF and GESIS may withdraw or suspend at any time and without prior notice the provision of the Services to those Users who fail to comply with the provisions of these Conditions of Use.
The declaration of any of these conditions as null, invalid or ineffective will not affect the validity or effectiveness of the rest, which will remain binding between the parties. The renounce by any of the parties to demand at any given moment the fulfillment of any of the general conditions stipulated herein shall not imply a general renounce of compliance with another condition or conditions, nor shall it create a right acquired for the other party.
The provision of the SQP service and these Conditions of Use of the SQP are regulated by German Law. The exclusive place of jurisdiction is Manheim, Germany.
